The Death Penalty and Scott Peterson

I am not against the death penalty, however, I am very strong in saying that they need to be absolutely sure about the person they are putting to death, and the death penalty should not be based on circumstantial evidence.

I am an avid crime fan and love reading books about people who have been convicted of crimes that are usually murder, Scott Peterson was no exception, I devoured the book about the investigation, and while I admit that there were errors in the investigation, I also look at the circumstantial evidence that led to Scott's arrest and and the events of his trial.

There was no solid, physical, proof that Scott killed Laci. But, with that being said, the circumstantial evidence was overwhelming.

One thing that bothers me is a house that Scott was staying at had a secret room, he borrowed a shovel from his sister Ann and didn't return it. Speculation was that he might have used the Shovel and secret room to bury something. Speculation was that it 'could' have been the jewelry that never turned up that Scott said she was wearing when disappeared.

The media played a huge part in convincing people he was guilty nationwide and worldwide. His actions, were not of one that was innocent. I'm not even talking about him getting a porn channel just days after Laci's disappearance, or wanting to sell the house. If I were abducted return or not I would not want to go back to a place that could have been the place that I was abducted at.

Things that give me reason to believe that Scott Peterson is guilty:
Lying to the police about the electricity being out in the warehouse the first night she was missing
Seeing Laci's vehicle in the driveway but she wasn't home
His actions upon arriving home, not finding Lacy, but changing clothes, taking a shower, washing clothes, all before he called his mother in law to say Laci is missing.
Having the police called by Laci's family and not by Scott
Several return trips to the bay
All to ready with an alibi and ready to prove it with receipts, asking for counseling numbers before determining Laci wasn't coming home.
Finding McKenzi home with dirty leash and not further investigating
Saying to Amber Frey that he 'lost' his wife, weeks, before she really did disappear.

The kidnapping theory just doesn't make sense according to the time table of disappearance which would have been after he left was very short because of the mention of meringue during a Martha Stewart show.

But, based on the circumstantial evidence listed above, yes I think Scott is guilty.
No I don't think he deserves death because its not an open and shut case.
I will be following the appeals, however, as much as I think he's guilty, without DNA evidence linking him to the murder, he deserves life in prison no parole.

Yes the Rocha's can understand what the Peterson's will feel should the appeals face, however I think the attorney has an uphill battle, and very likely a loosing one.

What does putting a man to death serve, especially if there is no evidence that he committed the crime?

Does it really give closure to the case to Laci's family, maybe some, but not completely. If Scott was wrongly convicted, then putting him to death just makes matter worse, and its one I would hope that the appeals court takes into consideration that the case was based on circumstantial evidence and uphold the conviction, but overturn the sentence of death.
